By accessing or using any HE360° Intelligence Platform product or service ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
1. Company Information
These Services are provided by Healthcare.Engineer LLC ("Company," "we," "us," or "our"), a limited liability company. The HE360° Intelligence Platform is a product of Healthcare.Engineer LLC.
2. Nature of Services
HE360° provides informational products and data analysis services based on publicly available government inspection records published by state health departments and equivalent regulatory agencies across the United States.
Our Services are NOT: legal advice, medical advice, regulatory compliance consulting, licensed referral agency services, healthcare consulting, or a substitute for professional guidance. We analyze and present publicly available data in an organized, accessible format.
2.1 Score Cards & Reports
HE360° Score Cards and Reports are informational products that organize, analyze, and present public inspection data using our proprietary scoring methodology. Scores reflect our algorithmic interpretation of public records and are not official government ratings, endorsements, or certifications.
2.2 Fix-It Services (ALF Owners)
Fix-It Services provide data-driven analysis and informational recommendations based on publicly available inspection records. Recommendations are informational in nature and should not be interpreted as legal, regulatory, or compliance directives. Facility owners should consult licensed compliance professionals, attorneys, or regulatory consultants before making operational changes based on our analysis.
2.3 Matching Services (Families)
Matching Services are informational tools that cross-reference user-provided preferences (budget, insurance, location, care needs) with publicly available inspection data and HE360° safety scores. We do not operate as a licensed senior placement agency or referral service. We do not receive referral fees, commissions, or payments from any assisted living facility. All matching is based solely on public data and user-provided criteria.
3. Data Sources & Accuracy
All HE360° scores, grades, and assessments are derived from publicly available government inspection records. While we make every reasonable effort to ensure accuracy:
- Public records may contain errors, omissions, or outdated information
- Inspection records reflect conditions at the time of inspection and may not represent current facility conditions
- Our scoring methodology is proprietary and represents our analytical interpretation of public data
- Scores are updated periodically as new inspection data is published, but there may be a delay between an inspection occurring and our score reflecting it
- We do not independently verify the accuracy of government-published records
Users should always verify information directly with facilities, state agencies, and other authoritative sources before making any decisions based on our data.
4. User Responsibilities
4.1 ALF Owners
By submitting facility data to HE360° Fix-It Services, you represent that:
- You are authorized to share such information on behalf of the facility
- You understand our analysis is informational and not a substitute for licensed compliance consulting
- You will independently verify all recommendations with qualified professionals before implementation
- You will not represent HE360° scores, badges, or assessments as government-issued ratings or certifications
4.2 Families & Residents
By using HE360° matching or family-facing products, you acknowledge that:
- Our matching and scoring are informational tools to assist your research, not definitive placement recommendations
- You should visit any facility in person before making placement decisions
- Insurance and Medicaid compatibility information is based on publicly available data and must be verified directly with facilities and insurance providers
- Our assessments do not guarantee the safety, quality, or suitability of any facility
5. HE360° Verified Improvement Badge
The "HE360 Verified Improvement" badge indicates that a facility's HE360° score improved following participation in our Premium Fix + Implement program. This badge:
- Reflects improvement in our proprietary scoring system only
- Is not a government certification, endorsement, or accreditation
- Is subject to revocation if subsequent public inspection records show a decline in the facility's score
- May not be used in advertising or marketing materials without written permission from Healthcare.Engineer LLC
6. Intellectual Property
The HE360° scoring methodology, algorithms, scoring dimensions, report formats, and all platform content are the intellectual property of Healthcare.Engineer LLC. Users may not:
- Reproduce, distribute, or republish HE360° scores or reports without written permission
- Reverse-engineer, decompile, or attempt to extract the scoring methodology
- Use HE360° data to create competing products or services
- Scrape, harvest, or bulk-collect data from the platform
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEALTHCARE.ENGINEER LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF REVENUE, LOSS OF BUSINESS, REGULATORY PENALTIES, FINES, OR DAMAGES ARISING FROM RELIANCE ON OUR SCORES, REPORTS, RECOMMENDATIONS, OR MATCHING RESULTS.
Our total liability for any claim arising from or related to our Services shall not exceed the amount you paid for the specific product or service giving rise to the claim.
We are not responsible for decisions made based on our informational products. All users assume full responsibility for their own decisions regarding facility operations, compliance, or placement.
8. No Professional Relationship
Use of HE360° Services does not create a professional-client relationship of any kind, including but not limited to: attorney-client, consultant-client, healthcare provider-patient, or licensed agent-client relationships. Our team members are data analysts, not licensed compliance officers, attorneys, healthcare providers, or registered referral agents.
9. Payments & Refunds
All HE360° products are sold as one-time purchases. Prices are as listed at the time of purchase. We reserve the right to change pricing at any time without prior notice for future purchases.
Refund requests will be considered on a case-by-case basis within 14 days of purchase. Digital products that have been delivered (PDF reports, matching results, score cards) are generally non-refundable, as they contain proprietary analysis. If you believe a product was materially defective, contact us at contact@healthcare.engineer.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Services after changes constitutes acceptance of the modified Terms. For material changes, we will make reasonable efforts to notify users via email or prominent notice on the platform.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in the State of Florida.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
